Covered Components:

This Limited Warranty covers the following components from mechanical defect and failure not caused by normal wear and tear or neglect: Fuel System (Fuel Pressure Regulator, Fuel Injectors, Carburetor, Fuel Pump), Electrical System (Fuel Pressure Regulator, Alternator, Regulator/Rectifier, Engine Control Module, Ignition Coils), Crankshaft, Cylinder Heads, Pistons, Camshafts, Cylinders), Brakes (Calipers, Reservoirs,), Exhaust (Muffler, Exhaust Pipe, Variable Exhaust Control), Chassis (Forks, Shocks, Swing Arm).

Excluded Components:

This Limited Warranty excludes any component not listed in “Covered Components,” and any items subject to wear and tear such as tires, batteries, audio equipment, accessories, expendable maintenance items (including, but not limited to spark plugs, filters, belts, and lubricants). Velvet Scooters cannot cover the engine and the main frame due to their age.

Procedure to Obtain Repairs of Covered Components:

You must promptly notify Velvet Scooters of a failure of a Covered Component within the period of the Limited Warranty. This notification must precede any repairs to the vehicle. Velvet Scooters reserves the right to, among other things, inspect the vehicle, specify a service provider where you must take the vehicle for repairs under the Limited Warranty, and reject any claims for repairs to Covered Components where Velvet Scooters has determined that the failure to the Covered Component is caused by a condition other than mechanical defect or by neglect and normal wear and tear. After Velvet Scooters determines that a Covered Component has failed in a manner applicable to the terms of the Limited Warranty, The Velvet Scooters will provide a replacement part free of charge. Nothing in the Limited Warranty shall be interpreted as obligating Velvet Scooters to reimburse you for any costs to install the Covered Component on the vehicle, including, but not limited to, costs associated with diagnosis, installation, and reimbursement for your inability to use the vehicle while it is undergoing repair(s).

Forum, Venue and Jurisdiction:

You agree that Viet Nam law governs the enforcement of the Limited Warranty, and any claims by you regarding the Limited Warranty, including, but not limited to, claims of breach of warranty, shall be litigated in a court of competent jurisdiction located in Viet Nam.

Severability:

Should a court of competent jurisdiction determine that the Limited Warranty is unenforceable under Viet Nam law, the offending provision or provisions shall be severed from the Limited Warranty without rendering the remaining terms unenforceable, null, and void. The severability of any provision in the Limited Warranty shall have no effect on any other agreements between you and The Velvet Scooters, including, but not limited to, the purchase and sale agreement, buyers order, or obligation to render prompt payment for the vehicle to The Velvet Scooters.

I hereby acknowledge that I have read and understand the Limited Warranty and agree to requirements of the Limited Warranty as contained herein.
